1. Eligibility and Account Registration

• Minimum age and capacity. You must be at least 18 years old and legally capable of entering into a binding agreement under applicable African laws to use the Service. The Service is void where prohibited by law. By using the Service, you confirm that you meet these requirements and that your use complies with all applicable laws and regulations.

• Single-use accounts. Each individual may hold only one account. You may not register on behalf of another person or entity or transfer your account without our prior written consent.

• Accurate information. You must provide accurate, current and complete information during registration and keep your account information updated.

• Account security. You are responsible for safeguarding your login credentials and all activities conducted through your account. You must notify us immediately of any unauthorised access or security breach. We are not liable for losses resulting from your failure to protect your account.

2. Use of the Service

The Service is intended for personal, non-commercial use by adults seeking dating and social connections within African communities and the African diaspora. You agree to use the Service only for its intended purpose and in accordance with these Terms.

2.1 User Conduct

You agree to:

• Treat other users with respect and refrain from harassment, abuse, hate speech or discrimination.

• Comply with all applicable African laws, including data-protection and consumer-protection laws.

• Use the Service lawfully and without infringing the rights of others.

You agree not to:

• Post or transmit content that is illegal, defamatory, abusive, sexually explicit, threatening, hateful or otherwise objectionable.

• Impersonate any individual or misrepresent your identity or affiliation.

• Provide false or misleading information.

• Solicit money, run scams, advertise commercial services, promote schemes, or send spam.

• Upload malware or interfere with the security or operation of the Service.

• Collect personal information from anyone under 18 years of age.

• Violate intellectual property, privacy or publicity rights.

We reserve the right to investigate violations and take appropriate action, including content removal, communication restrictions, suspension or termination of accounts, and reporting unlawful activity to relevant African authorities.

2.2 Content Posted by Users

• Responsibility for content. You are solely responsible for any content you submit, including profile details, messages, images or media (“User Content”). You confirm that you have the legal right to post such content.

• Licence to us. By posting User Content, you grant Date Africa Diamonds a non-exclusive, royalty-free licence to use, display, modify and distribute such content solely for operating and promoting the Service.

• Content removal. We may review, edit or remove User Content that violates these Terms or applicable law and may suspend or terminate accounts accordingly.

2.3 Proprietary Rights

All content on the Service, including text, graphics, logos, software and trademarks, is owned by Date Africa Diamonds or its licensors and protected by applicable intellectual-property laws. You may not use or reproduce such content without prior written permission.

3. Memberships, Fees and Payments

Date Africa Diamonds offers free basic membership and optional paid subscription plans.

• Pricing and payment. Fees are displayed at checkout and may change with notice. Payments are non-refundable except where required by applicable African consumer-protection laws.

• Auto-renewal. Subscriptions may renew automatically unless cancelled before the renewal date via account settings.

• Payment processors. Payments are handled by third-party processors. You confirm you are authorised to use the selected payment method.

4. Safety and Interactions with Other Users

Date Africa Diamonds provides a platform for connection but does not verify user identities or conduct background checks. You are solely responsible for your interactions with other users.

• Exercise caution and avoid sharing sensitive personal or financial information.

• Meet new connections in public places and inform a trusted person.

• We are not liable for harm, loss or disputes arising from user interactions.

5. Privacy and Data Protection

Our handling of personal data is governed by our Privacy Policy. We comply with the Nigeria Data Protection Act 2023 (NDPA) and similar African data-protection frameworks.

6. Intellectual Property and Copyright Complaints

• Our intellectual property. All platform content and branding belong to Date Africa Diamonds.

• User content. You retain ownership of your content but grant us a licence to operate the Service.

• Complaints. Rights holders may report infringement, and we may remove content and take appropriate action.

7. Suspension and Termination

• We may suspend or terminate accounts for violations of these Terms or applicable law.

• You may close your account at any time. Paid subscriptions remain active until the end of the billing period.

8. Disclaimers and Limitation of Liability

• No warranties. The Service is provided “as is” and “as available.” We do not guarantee uninterrupted or error-free operation.

• User conduct. We are not responsible for user behaviour or content.

8.2 Limitation of Liability

• We are not liable for indirect or consequential damages.

• Our total liability is limited to the greater of the amount paid by you in the previous 12 months or ₦50,000.

9. Indemnification

You agree to indemnify and hold harmless Date Africa Diamonds from claims arising from your use of the Service, your content or violation of these Terms.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of Nigeria. Disputes shall be resolved exclusively by Nigerian courts, subject to mandatory consumer protections in applicable African jurisdictions.

11. Anti-Fraud and Compliance

You agree not to use the Service for fraud, scams or money-laundering. We may report suspicious activity in accordance with applicable African laws.

12. Miscellaneous

• Entire agreement. These Terms and our Privacy Policy constitute the entire agreement.

• Severability. Invalid provisions do not affect the remainder.

• Force majeure. We are not liable for events beyond our control.
